Things to Do After An Accident - If you have been involved in an accident or injury, here are some steps to take to protect your legal rights:
- Record the incident in writing including all the details you can remember. You may think you will not forget anything, but over time many details can be forgotten and you may be surprised how many things you remember as your are writing.
- Obtain names, addresses and telephone numbers of all witnesses.
- Photograph the scene where the injury occurred and any visible injuries (cuts, bruises). Also try to take pictures of any items/products that may have caused the accident. Make detailed notes about the injuries, especially those that may not be clearly visible in the photos.
- In the days following the accident update your notes and report any effects of the injury(ies). If you document everything it will help your case later. Headaches, leg and back pain and other "non-visible" injuries should also be noted. Be sure to report any changes in memory, increased confusion or disorientation, even if you think these are minor problems at the time.
- Talk to no one about the incident or injuries other than the victim's personal physician or lawyer. Do not discuss the incident with insurance companies and do not sign anything until you consult an attorney.
- Consult a lawyer before answering questions from insurance companies or their lawyers. Say nothing and sign nothing without talking with your lawyer first. Truthful statements made in an attempt to be helpful can easily be misinterpreted and turned against you.
- Obtain and keep receipts for all expenses relating to the incident and make note of any financial losses, such as missed work.
In the event of a vehicle accident, add these steps:
- Insist that a report be filed with the police, sheriff or state highway patrol and try to take pictures of the accident. Pictures of the accident before the vehicles are moved could be beneficial to your case.
- Consult a lawyer before paying a ticket or appearing in court, even if you believe you were partially at fault. Admissions made in traffic court could unfairly hurt your case.
- Tell your physician or surgeon exactly how the injury occurred and describe all symptoms and complaints. Be sure to report memory problems, confusion or disorientation, however minor these things may seem at the time. If you or a loved one has been the victim of an accident or injury, you should consult with an Indiana Personal Injury Lawyer as soon as possible.
