How do I know if I have a good case?
Talking to an experienced personal injury lawyer is the best way to evaluate the merits of your case and claim. Hensley Legal Group, PC offers a free, no obligation evaluation of your case and will tell you whether your case has merit. There is no obligation to you whatsoever for this free consultation.

How much do you think my claim is worth?
It is impossible to answer this question before investigating your case; however, we may be able to give you an estimated range based on the facts and circumstances of your situation.

Some factors that determine the value of a claim include how severe the injuries include

  • The type of injury are permanent or temporary
  • Was the injured party was an income earner or supporting others
  • The cost of medical treatments,
  • Is pain and suffering a factor?
  • Was negligence involved?
  • Will lifelong care be needed? Please feel free to call or e-mail us and we would be happy to give you the benefit of our experience and offer you a free, no obligation consultation.

What if I have a good case but cannot afford legal fees?
We take most cases on a contingency fee basis, which means you will not owe us any fees up front and will only pay if, and when, we obtain compensation for you. Our fee will be percentage of what we collect on your behalf.

The insurance company representative told me I don't need a lawyer. Is this true?
Insurance companies' representatives are paid to minimize the amount of compensation that must be paid. We highly recommend that you have a lawyer that is focused on your best interests. We typically suggest that our clients not talk to insurance companies until they have a lawyer representing them.

The insurance company is offering a good settlement, why shouldn't I just accept it?
It is almost always a mistake to accept a settlement without consulting an attorney. Once you agree to a settlement, you lose any other rights you may have had. Talk to an attorney first. You could find out 6 months down the road that your injuries are resulting in other problems. If you agree to settle you have no recourse.

Will I have to go to trial to collect what is due to me or can we settle out of court?
While the majority of accident claims we handle do settle without having to go to court, there are times when you are likely to achieve better results if we do go to court. This is an evaluation we will make together.

How soon can we begin settlement negotiations? I need money now to pay my bills.
Usually it is not a good idea to begin any negotiations until there has been complete recovery from the accident or injury and we have a clear idea of the extent of any permanent injuries and/or disability and/or ongoing needs. Unanticipated medical bills, additional income loss, and ongoing pain and suffering can make an early settlement a big mistake. In order to maximize your recovery, the full extent of your injury, losses and suffering must be known. However, we will do everything possible to expedite matters and begin the process as soon as it is in your best interests to do so.

How soon after the accident do I have to file a claim? Is there a time limit? I didn't realize I was hurt until later.
You typically have two years to bring a claim, but investigation of your claim should begin as soon as possible.
